Lawful Development Certificates …

 

Planning permission for the replacement of a dwelling in Powys was initially refused on the basis that it was considered that the residential use of the building had been abandoned (despite the owners continuing to pay their Council Tax!).  The submission of an application for a Lawful Development Certificate successfully demonstrated that this was not the case … and it is now proposed to alter and extend the building and convert an adjacent barn.

Following a Council’s attempt to retrospectivly gain control over the occupancy of a number of holiday chalets it was successfully argued, through the submission of a Lawful Development Certificate, that they could be occupied without any restriction as permanent dwellings.
